Terms and conditions

These terms cover use of faillist.co.uk. Last updated 5 September 2026. This is a product agreement, not legal advice.

1. Who we are

The service is provided by Fail List Ltd (“we”, “us”). Contact hello@faillist.co.uk. The site is faillist.co.uk.

2. The service

Fail List is software for the inspect–price–prove loop: surveys, fail lists, priced quotes and evidenced jobs on one Asset id. It is a record-keeping tool. It does not certify, test, approve or guarantee a fire door, fire-stopping system or any other product.

You remain responsible for workmanship, competence, method statements, and any claim you make to your customer.

3. Accounts

The first person to create an organisation is the owner. The owner (and admins they appoint) may add employees and give them roles. You must keep passwords confidential and only give access to people in your organisation who should have it.

During user testing the Pilot plan is free. Paid plans, if we offer them later, will be described on the pricing page before we take a card.

4. Your content

You own the photos, asset data, quotes and other records you put in Fail List. You grant us a licence to host and process that content only so we can provide the service to you.

You must not upload unlawful material, or personal data you have no right to process.

5. Acceptable use

Do not probe, overload or reverse-engineer the service. Do not use it to misrepresent that Fail List certified work. Do not share login details in a way that lets someone outside your organisation act as you.

6. Availability

We aim to keep the service up, especially during user testing, but we do not promise uninterrupted access. We may change or withdraw features as the product is built.

7. Liability

The service is provided as-is. We are not liable for decisions you make on site, for failed inspections by others, or for loss of profit. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

8. Fees

During user testing the Pilot plan is free. If we introduce paid plans we will describe them on the pricing page and give you notice before taking a card. Prices are in pounds sterling and, when charged, will be plus VAT where applicable.

9. Ending an account

You can ask us to close an organisation by emailing hello@faillist.co.uk. We may suspend or close an account that breaks these terms or that we reasonably believe is a risk to the service or to other users.

10. Changes

We may update these terms as the product is built. The date at the top of this page will change. If a change is material we will say so in the product or by email. Continued use after that is acceptance of the new terms.

11. Law

These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
